BOOKING TERMS & CONDITIONS – Cayman Sparadise

Welcome to Cayman Sparadise, your premier mobile service company in the Cayman Islands. Please carefully review the following terms and conditions before indulging in our extensive array of holistic, beauty, and wellbeing services.

Definitions

1.1 CS: Refers to Cayman Sparadise.

1.2 Client: Any person, company, or organisation seeking our bespoke services.

1.3 Booking: The designated period during which a skilled Therapist delivers personalised services to the Client, as mutually agreed upon in advance via our client booking form or contract.

1.4 Service: Encompasses the holistic, beauty, and wellbeing services requested by the Client through our Website Booking Form, phone, or email.

1.5 Therapist: Any professional provided by CS, ensuring the seamless execution of services on behalf of our esteemed clients.

1.6 Individual: Signifying the individual guest or employee of the Client attending the booking and availing of the requested services.
1.7 Premises: Denoting the service location address provided by the Client for the seamless delivery of our unparalleled services.

The Provision

2.1 CS commits to providing highly qualified Therapists to the Client at the specified Premises for the agreed-upon duration.

2.2 Our Therapists are meticulously instructed to deliver the requested services, catering to the unique needs of each Individual with professionalism and diligence.

2.3 In the event that an assigned Therapist is unable to perform the booked services due to unforeseen circumstances such as sickness or injury, CS pledges to make every reasonable effort to fulfil its obligation by providing a suitable alternative therapist. This may require the Client/Individual to consider alternative treatment options, with no refund issued for the replacement service. If any part of the Booking remains unfulfilled, CS will apply a pro-rata deduction for the cost of the uncompleted portion.

2.4 Acknowledging the unpredictability of Force Majeure events, CS agrees to promptly notify the client and reserves the right to cancel the booking. In such instances, where services have been pre-paid but not rendered, the Client will be presented with the option of rescheduling or a full refund.

2.5 Our Therapists retain the discretion to refrain from providing services to any Individual deemed unfit to receive such care. This includes, but is not limited to, instances of misconduct, broken skin or lesions, undisclosed medical conditions, intoxication, pregnancy (with the exception of pregnancy massage, which is not provided), and any inappropriate or sexually suggestive behaviour. Immediate termination of service will result from such behaviour, with the Client/Individual remaining liable for the full payment of the scheduled service.

2.6 Individuals aged 16 or younger require parental or guardian consent to undergo treatments. A limited menu of age-appropriate treatments will be offered at the time of booking, with a mandatory presence of a parent or guardian throughout the treatment.

2.7 CS is committed to providing a seamless experience through the provision of an online booking system or template schedule. Treatment times include changeover, resulting in actual treatment times being slightly shorter than those listed.
2.8 While CS strives to accommodate first treatment choices for all Individuals, occasional circumstances may necessitate the request for a second-choice treatment if the first choice cannot be fulfilled.

Data Protection

3.1 All information shared by the Client and Individuals in connection with CS services will be treated as confidential and not disclosed to any third party without the prior written consent of the Client or Individual.

3.2 CS acknowledges the importance of communication between Clients and Therapists and therefore shares contact details for the duration of the Booking. Post the Booking date, any further communication is subject to the Client’s consent provided to the Therapist on the day of the Booking.

3.3 CS respects privacy preferences; hence, the Client will not be contacted for marketing purposes via email, phone, or text message unless explicit consent is given. Postal communication will be avoided if the Client expresses a desire not to be contacted. Clients can modify their marketing preferences at any time by reaching out to CS via email at [email protected].
3.4 CS strictly adheres to an equal opportunities policy, ensuring that no Individual, Client, Therapist, or Employee faces discrimination based on racial, ethnic or national origin, gender, marital status, disability, sexual orientation, age, or religious beliefs.

Therapists

4.1 Therapists are obligated to maintain a professional and respectful demeanour at all times. CS ensures that our Therapists utilise our own products and equipment for the treatments offered.

4.2 Each Therapist is an employee of CS, engaged under a contract for services.
4.3 Therapists are entitled to pre-scheduled breaks during the course of the day.

 

 

Client’s Obligations

5.1 The Client must provide a suitable area for the service to take place, along with a designated contact person for CS to liaise with.

5.2 All Individuals receiving therapy treatment are required, by agreeing to these terms and conditions, to disclose any health conditions that the Therapist must be aware of during the performance of their duties. This disclosure can be made either at the time of service or during the booking appointment via the notes section. By agreeing to the terms and conditions, the Client accepts the responsibility to disclose any conditions and agrees not to hold CS liable for any undisclosed health-related issues.

5.3 The Client is responsible for maintaining the premises/venue, both indoors and outdoors, in a safe and efficient condition.

5.4 The Client must inform the Therapist of any health and safety policies and practices relevant to the Premises that the Therapist must adhere to while on-site.

5.5 The Client shall make reasonable efforts to ensure that Individuals limit their intake of alcoholic beverages prior to receiving complementary therapy treatment, adhering to the legal limit for driving as a suitable guideline.

5.6 While Therapists will make every effort to accommodate changes due to lateness, CS disclaims any liability for any loss of treatment time in such events.

5.7 The Client is responsible for providing accurate address details and relevant contact information for the Event. CS will not be liable for any loss of treatment time due to inaccurate address information.

5.8 Additional treatments on the day will only be accommodated if a rebooking is made.

5.9 The Client agrees to hold CS harmless from and against all claims, injuries, suits, and damages arising out of the performance by the therapist assigned to the client’s booking.

Payment By The Client

6.1 The agreed fee for the Services is as displayed on the website www.caymansparadise.com. The Client can choose to pay online by card or opt for on-site payment, either in cash or through our merchant vendor card machine.

Cancellations and Charges

7.1 Once a booking form is accepted or a Client contract is issued, cancellations will incur charges as follows:

7.1.1 Cancellations made with 24 hours’ notice or more – 100% refund.

7.1.2 Cancellations made with 12 to 24 hours’ notice – 50% refund.

7.1.3 Cancellations made with less than 12 hours’ notice – no refund.

7.2 CS reserves the right to cancel the provision of the Service without notice in case of Therapist illness or other emergency reasons, or circumstances beyond its control. CS endeavours to minimise cancellations but acknowledges that providing an alternative Therapist may not always be feasible. In such cases, the Client will be offered an alternative day, or a full refund will be issued for treatments not received.
7.3 Refunds due will be processed back to the original payment method within 10 days of the cancellation date.

Complaints and Refunds

8.1 If a Client/Individual receives a treatment that falls short of expectations, direct communication with the Therapist during the Booking is encouraged for immediate resolution.
8.2 Should the Client/Individual remain dissatisfied after communicating with the Therapist, prompt contact with CS is essential for further action or refund discussions. Supporting evidence, such as photographs, may be requested. To be considered for a refund, CS requires notification of dissatisfaction within 5 days of the treatment.

Liability
9.1 CS shall not be liable to the Client for any loss, injury, damage, expense, or delay suffered by the Client. This exclusion extends (but is not limited) to the consequences of any act or omission, whether willful, negligent, reckless, dishonest, or otherwise, occurring during the Booking on the part of the Client. The Client acknowledges that CS fees are set on the basis of having no such liability.

 

Virtual Reality Release of Liability

10.1 Due to the unpredictable nature of human responses to virtual reality, including dizziness, nausea, seizures, and fear of heights, participants are required to read and agree to this waiver releasing CS and Now XR, Inc. (doing business as Relax VR) from any liability related to the use of virtual reality units.
10.2 Participants should cease using the virtual reality unit if any discomfort arises. Participants, by agreeing to the terms and conditions, express their willingness to participate in the program and understand the following:
10.2.1 It is not recommended for children under the age of 13 to use virtual reality units.
10.2.2 Pregnant women, the elderly, or individuals with serious physical, mental, or visual conditions should consult their doctor before participating.

10.2.3 Individuals with a medical history of epilepsy, fainting, severe dizziness, seizures, photosensitivity, tinnitus, asthma, or other symptoms triggered by flashing images should consult their doctor before participating.
10.2.4 Participants are not wearing a pacemaker or other implanted medical device, or have consulted with their doctor or medical device manufacturer before participating.
10.2.5 Participation is voluntary, and participants assume all physical, psychological, and financial risks associated with it.
10.2.6 Participants acknowledge, by agreeing, that they have read and understood all the terms of this release form, voluntarily waiving substantial legal rights, including the right to sue CS and Relax VR and/or its employees.
10.2.7 For participants below 18 years of age, the parent or legal guardian must consent to the terms and conditions on their behalf.

Amendments
11.1 CS may update these terms periodically by posting a new version on the CS website. Clients are encouraged to check this web page occasionally to stay informed about any changes.

Jurisdiction
12.1 These conditions and any contract incorporating them shall be subject to Acts and the exclusive jurisdiction of the Cayman Islands.
